Western Trios appeal to be heard this week

The matter is fixed for hearing on Thursday, February 23.

Leave was granted or allowed to the trio by the Supreme Court on Dec 14, 2016 after the court was satisfied on their grounds of appeal.

One of their grounds of appeal is that that they were found guilty of misappropriating K350,000 and an additional K24,000 and not K7,060,000- the amount to which they were sentenced to 10 years in jail for.

The three were convicted on July 26,2016 by the National Court for conspiring to defraud the state and misappropriating monies amounting to K7 million.

The National Court at Waigani has sentenced Western Governor Ati Wobiro, former Western Provincial Administrator Dr Modowa Gumoi, and Fly Care Foundation Inc. boss Norman Carl May to 10 years in prison.

​Western trio sentencing today

Justice Martin Ipang is expected to hand down his decision this morning.

The three were found guilty on July 26 for conspiring to establish the Fly Care Foundation between January 1 and December 30, 2013, by using over more than K7m funding from the provincial government.

They conspired to misappropriate funds through a memorandum of agreement between Governor Wobiro and May for the Foundation to deliver projects in the province.

Pre-sentence reports given to Wobiro’s lawyers

The three and their lawyers returned to the Waigani National Court today for submissions on their sentencing to be done however, that was further adjourned to next Monday, Sept 26.

It was further adjourned to give time to their lawyers to make submissions on the appropriate sentence based on the probation office’s pre-sentence reports.

They remain on an extended bail of K10,000 till Monday when they return before Justice Martin Ipang.

Wobiro’s submission on sentence end of this month

Governor Wobiro, Provincial Administrator Dr Modowa Gumoi, and boss of Fly Care Foundation Inc. Norman Carl May, were all allowed bail at K10, 000 each on Thursday afternoon after they showed exceptional circumstance before the court on their medical grounds.

This bail was allowed after they were found guilty on July 26. The court is yet to hand down its sentencing on the three.

They are expected back in court during the last week of August when Justice Martin Ipang returns to Port Moresby for Supreme Court case sitting.

Ruling on Wobiro trial tomorrow

This decision from the trial has been outstanding since April when the trial was conducted in Daru. Submissions on what should be the decision of the trial were done on May 25 by Wobiro’s lawyer and lawyers from the tate.

Governor Ati Wobiro and his co-accused; Western Provincial Administrator Dr Modowa Gumoi, and the chief of Fly Care Foundation Inc. Norman Carl May are facing identical charges of misappropriating funds totaling K7.9 million, charges that arose from counts of abuse of office, conspiracy to defraud and misappropriation of public funds.
