Supreme Court bench dismisses UBS loan case

A three-man Supreme Court bench today dismissed the Supreme court reference filed by Opposition Leader Don Polye challenging the legality of the Government’s decision to acquire the K3 billion from the Union Bank of Switzerland.

The case was dismissed for warrant of prosecution after Don Polye’s lawyer Loani Henao failed to appear in court in time for the hearing at 9:30 this morning.

Lawyer representing the Prime Minister and the NEC Ian Molloy was in court when the matter got dismissed.

What was returnable this morning was a standing application where Polye was to inform the court through his lawyer that he had enough grounds to challenge the Government’s decision to acquire the K3 billion UBS loan.

The outcome of the standing application would then proceed to the substantial hearing of the reference, however Justice Derek Hartshorn, Collin Makail and Don Sawong dismissed the application and the entire proceeding due to Polye’s lawyer’s failure to be in court on time.

Polye was ordered by the court to cover costs for the proceeding.
