Potape to file urgent appeal against decision

Member for Komo-Magarima Francis Potape has indicated he will have his lawyers file an urgent Supreme Court application seeking to dismiss the decision of the National Court yesterday.

Speaking to the media yesterday afternoon, Potape indicated his lawyers will be filing an appeal at the Supreme Court to overthrow the National Court’s decision yesterday.

He said the application he will be filing seeks to allow him to continue in his function as Hela governor following his election by the members of the Hela Provincial Assembly meet on December 29.

The National Court yesterday morning granted an interim injunction sought by the Hela Regional Member Anderson Agiru, restraining Potape and the other members of the Hela Provincial Assembly from making any decisions in reliance of the purported resolution of the meeting held in Tari on December 22 to remove Agiru as governor.

The court also ordered to allow Agiru to continue in his role as Hela Governor by preserving the status-quo while the National Court deals with the substantive issue.

The substantive issue the court will now deal with is whether proper processes were followed by Potape and the other members of the Hela Provincial Assembly.

The trial will be held on February 19 at the National Court.
