Sex case against student dismissed

The allegation of sexual penetration against a student studying at the University of Papua New Guinea has been dismissed by the Waigani District Court.

The court found the information charging the accused was incorrect which led to inappropriate charges against the 26 year old man from Enga province.

Magistrate Cosmas Bidar dismissed allegations against Max Sumbakain yesterday (Feb 4) after they found that the said victim had been in a consensual relationship with the accused since their high school days.

The court also dismissed the case on the basis the information charging him was not right as the said victim was actually married to someone else at the time the allegation was made.

Bidar said there was no evidence the said victim’s bruises were from the accused when she was married.

He said the accused only found out that his girlfriend was actually married to another man when relatives of her husband turned up on campus looking for her after she went missing from home.
