Parkop: Polye must stop issuing petty complaints

Parkop was responding to Polye's comments on the eviction of a 94-year-old Fuzzy Wuzzy angel in the nation’s capital.

Polye claimed that Parkop must step in and help the old man if he is serious about his “Walk for Life” as this is true the walk for life act.

He further claimed that a real walk for life is where there’s help when a family’s life is under threat and venerable out on the street and not a politically motivated campaign using public office and funds.

Opposition Leader and sitting Kandep MP Don Polye maintains his lead in the Kandep Open Seat recount with 15,263 votes. This was in the first preference counts after close of counting yesterday.

Court to give Kandep applications ruling

The Slip rule application filed by sitting Kandep MP, Don Polye is asking the Full court to revisit its decision from Sept 6.

Polye is also asking the Court to stay the re-count of those boxes.

Submissions were made in court today on whether a Single judge has jurisdiction to stay a re-count pending the hearing of the Slip rule application if it is allowed to be heard by the full court. 

That re-count commenced in Wabag town today at 10am as per orders of the Supreme Court on Sept 6 for the Electoral Commission to conduct a re-count of ballot boxes within 30 days.

Kandep case hearing listed for Monday

Justice Stephen Kassman, who listed the matter for hearing on Sept 26, said there is a possibility a member of the three-judge bench that ordered the re-count of ballot boxes on Sept 6 will not be available on that day.

Parties representing Don Polye, Alfred Luke Manase and Electoral Commissioner, appeared before Justice Kassman of the Supreme Court this morning for directions.

Following the ruling on Sept 6, Polye filed a slip rule application asking the court to re-visit its decision, alleging that the full bench made an error by ordering a re-count.

Judge: I have no jurisdiction to stay recount

Justice Stephen Kassman this afternoon said he does not have jurisdiction to hear the stay application filed by Don Polye on Sept 15, seeking to stay the re-count of ballot boxes in the Kandep Open seat.

Following the ruling on Sept 6, Polye filed a slip rule application asking the court to re-visit its decision, alleging that the full bench made an error on Sept 6 by ordering a re-count.

He also went before Justice Kassman on Sunday in a special fixture Supreme Court sitting, asking the court to stay that recount.
