Awesa cleared of stone wall allegations

Member for Imbonggu and Works Minister Francis Awesa has been cleared of allegations of misconduct in office against him.

Members of the Leadership Tribunal led by Justice Goodwin Poole found the leader not guilty to both allegations levelled against him.

Awesa was referred to the tribunal on the allegation he breached section 27 of the Constitution  between July 2007 and March 2013 when he built a stone wall on his property in Port Moresby that “caused disharmony’’.

The tribunal found him not guilty as they determined that he constructed that stone wall fence in 2005 before  his election to office.

They also found that the leader had constructed the fence on his own property.

The tribunal members found that the leader made an application to NCDC to seal off the end of his property thus stopping further criminal activities in the area.

They found he built that easement on section 64, lot 23 and not on public land preventing public access as per the first allegation.

The second allegation the leader was cleared of was that he failed to demolish the fence after he was issued notices by NCDC.

The tribunal found the application for development to the NCDC building board about the fence was applied under section 64 lot 22 and not lot 23.

Justice Poole said the tribunal accepted that this application and approval was a result of a clerical error and the complainant in the matter did not develop the land.

He said the tribunal was less satisfied that the leader demeaned his office.

Awesa in addressing his supporters outside the court house said he was pleased with the decision of the tribunal.
