Court adjourns PM’s stay application

The Court said there was no urgency for the court to hear the stay application today.

The Prime Minister is seeking to stay the process of the Private Business Committee, in the event another motion of Vote of No Confidence is filed by the Opposition.

The Opposition's Vote of No Confidence motion against the Prime Minister filed on 7 May 2019 was withdrawn on 20 May.

AG withdraws stay application

The application was withdrawn on Wednesday May 22nd by Manase’s lawyer, John Griffin QC, before a three men bench consisting of Justice Derek Hartshorn, Collin Makail, and Oagile Bethuel Dingake.

The stay application to restrain Parliament and the Private Business Committee from entertaining or dealing with the notice of a motion for a vote of no confidence was filed by Manase on May 15th in relation to the VONCM filed by the Opposition on May 7th.

Potape’s application adjourned

Chief Justice Sir Salamo Injia adjourned the case yesterday to give time to lawyers to obtain specific instructions from their clients in the case.

The adjournment was granted after lawyer for Koroba-Lake Kopiago MP, Philip Undialu, told the court he was yet to get instructions from his client, who was on a campaign trail in Hela.

Both Potape and Undialu are contesting the Hela Regional Seat in the 2017 National General election.

Bando files stay application against suspension

The motion was filed soon after the Waigani National Court agreed to review his suspension last month.

Leave was granted by Justice Les Gavara-Nanu after Bando’s lawyers established that there were serious issued to be tried and that he had sufficient interest in the case.

Bando’s lawyer returned to court today and the matter was set for hearing on Thursday.

They will be asking the court to stay his suspension from office. Bando is also seeking restraining orders against the Public Service Minister, Hela Provincial Executive Council and its Chairman Francis Potape.

SHP election manager position battled in court

Lawyers representing Jacob Kurap came before Justice Derek Hartshorn today with an application seeking to stay the National Court’s decision that upheld David Wakias' judicial review, reinstating him to his former position.

The court after hearing submissions on the application reserved its ruling to a later date.

The National Court on March 17 ruled that PNG Electoral Commissioner Patilias Gamato’s decision to appoint Jacob Kurap as the Southern Highlands provincial election manager on 4 Nov 2014 was illegal.

OC bids to stay nomination fee increase

Lawyer representing Prime Minister Peter O’Neill was allowed to join as a party or intervener in the reference on Thursday when the matter came before a three-man Supreme Court bench.

The application was listed to be moved in court however it was adjourned to next week because the Prime Minister’s lawyer was yet to see the Hansard or the official recording of Parliament session on January 26.
