Court hears objections in Hela petitions

Justice Ellenas Batari this morning, heard arguments on the objection Undialu’s lawyer filed in response to the petition, Dr Hewali Hemia filed.

Undialu’s lawyer Goiye Gileng, submitted in court that Dr Hemia’s petition lacked the material facts to support the allegations of illegal practice by the Electoral Commission.

Dr Hemia is challenging the whole electoral process by which Undialu was elected governor. He claims the process from polling, to counting, scrutiny and elimination was not done right.

Hela petitions to be heard separately

Justice Ellenas Batari today granted an application by Undialu, allowing the trial to be heard separately after the National Court on 17 November last year, ordered that the two petitions go for hearing together.

The court varied the order which earlier joined the two petitions for trial.

The hearing of the petitions will take place pending the outcome of objections filed by the Electoral Commission challenging the competency of the petitions.
