No show by refugee, case adjourned

 Magistrate Alex Kalandi adjourned the case after the defendant did not turn up in court again today after it was stood over from Tuesday. It is not known if he was informed of his case hearing today. 

The magistrate also instructed prosecution to order the arresting officer in the case to appear next week and explain to the court how the defendant was released on bail of K150.

 Movafagh was arrested on Jan 10 over allegations of being in possession of marijuana.

False pretense lands man in court

Four years on after the money was borrowed, Lawrence Suzuata, 51 of Lonahan village, Buka has been rearrested by police over the allegations.

He appeared in court on Monday and was told police have completed its investigation files against him.

Magistrate Mekeo Gauli adjourned his case to Feb 16 to allow police time to serve what is called the hand up brief to the defendant.

Suzuata told the court he is yet to engage a lawyer to represent him in court.

Man plead guilty to threatening magistrate

Michael Taria from Kuraip village, Kokopo, went before the Boroko District Court on Tuesday where his charges were read and explained to him.   He pleaded guilty to all three charges.

Taria was arrested on Jan 12, 2017 and charged with using threatening and insulting words under section 7(b) of the Summary Offense Act. He was also charged with throwing missile, a charge under section 28 (2) (a) of the Summary Offense act.

The court is expected to hear submissions on his penalty or sentence on Jan 26.

Asians in court over sexual assault allegations

The men, 56-year-old Huang Yurong and 20-year-old Huang Wumin appeared before Magistrate Mekeo Gauli of the Waigani Committal Court on Monday where their charges were read and explained to them.

Their cases were adjourned to Feb 16 while police will continue their investigations.

They were arrested on Jan 11, 2017 and released on bail of K1,000 on Jan 13 on the conditions they do not re-offend, interfere with state witnesses, leave NCD and PNG without the court’s approval and they must report to the court registry every fortnight Friday.

Abuse of process sees case dismissed

The court also raised issues on the abuse of police officers in arresting suspects without according their rights to silence.

The case stems from a fight that took place over a road block at the ATS settlement on Dec 23 last year which saw four men arrested and charged with the unlawful assault of a man.

Magistrate Laura Kuvi this week dismissed the case against 59-year-old Leo Pami from Komo, 27-year-old Koli Hangana from Koroba, 23-year-old Larry Wai and 23-year-old Samson Punga also from Komo Hela Province.

Magistrate: Police must produce search warrant

A magistrate at the Boroko District Court made these comments in relation to a matter that came before her on Wednesday this week.

Magistrate Laura Kuvi said police cannot enter people’s premises without a search warrants or unless they are on court pursuit.

“It’s different when they are chasing somebody and that person runs into your yard, its immediate pursuit and they can enter your premises. But It’s different when they are coming to conduct a search. They need to obtain a search warrant,” she said.

Police officer Numbos appears in court over airport heist

Steven Numbos went before Magistrate Alex Kalandi on Wednesday with his lawyer, however his case was adjourned to next week because his lawyer sought an adjournment for him to be arraigned then.

Arrested on Dec 30 ,2016, the 44-year-old from Kragur village, Wewak, East Sepik Province is facing two charges. He was charged for being in possession of ammunition without license and possession of a pistol without license. This same pistol was allegedly used in the K1.2 million robbery at the Tropic Air Terminal on Nov 3, 2016.

In court for accusing man of sorcery

Eddie Abbie briefly appeared before Magistrate Alex Kalandi on Monday however his case was adjourned because his lawyer was not in court.

The magistrate told Abbie in court that his case was taking too long and he expects his lawyer to be in court at the end of the month.

The trial in the case is part-heard and defense was supposed to make its submissions after police prosecutions made their submissions, however that is yet to be done.

Home allegedly sold over false pretense

Police are investigating and are nearing the completion of investigating files for Taiven Karo, a 40-year-old man of Keketuantu village, Kainantu, Eastern Highlands Province.

Karo was arrested on Nov 25, 2016 and charged with obtaining money by false pretense with intent to defraud a Monica Kos with a sum of K179, 875. 28 for the sale of the property, section 307, allotment 63.

Hela man face stealing allegations

The man is from Hela Province and is facing allegations in court that he stole K390,000 from his neighbor at Gerehu, by pretending he owned the property he lived on which his neighbour intended to buy off.

Leonard Hawakaya, 55,  of Pureni village, Koroba district was arrested by police and charged on Oct 21, 2016 with stealing and obtaining a sum of K390, 000 by false presence.

His case briefly came for mention this week in court and was adjourned for another month to give police more time to investigate it.
