Woman guilty of misappropriation

A woman from Kirakira village in NCD, who received K120,000 for the sale of a piece of land at Taurama, has been convicted of misappropriation by the National Court.

Girigi Goasa Mose made representations to the owners of JDM Ltd that she was selling a piece of land for K150,000 in 2009.

Monies were paid however, no title was given nor paid back since 2011, resulting in her arrest and prosecution.

Mose received a total of K120,000 between November 2009 and February 2011 for a piece of customary land in Taurama, known as Odahara, Portion 2763c – 2765c.

The land was to be sold for K150,000 to JDM Ltd. The figure was later increased to K275,000.

However, while payments were being made by JDM Ltd, they found out two other individuals were also on the same piece of land.

The Waigani National Court found Mose had no authority to sell the subject land, coupled with the land not specifically identified by survey grid map.

There was no evidence of title shown in court during the trial.

Acting Judge Nickolas Miviri said she falsely pretended she had a property to sell when she, in fact, did not. 

Payments of K120,000 were made but no title documents to the land were given. Two other notable persons also claim rights to the same land.

Mose was convicted and will be sentenced at a later date. She remains on an extended bail.
