Student hit-and-run case still pending

The Public Prosecutor will decide on the next stage of a dangerous driving causing death case.

The case involves a hit-and-run accident of a student at Murray Barracks on Oct 5 last year.

The case of the driver who is allegedly responsible for the death of Port Moresby female student, the late Ann Murray Makis, opposite SVS at Two-Mile, returned to the Committal Court for mention today.

Allen Alex of Korobosea village, NCD, was arrested on Oct 5, 2016, and charged with dangerous driving causing death after he surrendered himself to police in fear of his life. He was allowed bail on Oct 14, 2016.

He was driving a Toyota Coaster Bus along the Sir Hubert Murray Highway on Oct 5 last year when he allegedly lost control of his vehicle and hit the Grade 10 student.

The bus belongs to the Don Bosco Technical Secondary School at Gabutu.

The deceased was a student of Caritas secondary and according to facts before court, she was returning home after school when she was run over by the bus.

Investigations into the allegations have not been completed and a hand up brief is yet to be produced before the court by the Police investigating officer.

Magistrate Cosmas Bidar said they have asked the Public Prosecutor to decide, through what is called an election of the case, whether it will be heard by the Grade 5 District Court by way of trial or go through the Committal Court process under section 95 of the District Court Act.

Under section 95 of the District Court Act, the Committal Court will basically screen if it has enough evidence to commit the case for trial in the National Court.

Under the Grade 5 Court, a trial will be conducted in the District Court and the matter will end there.

The matter will return to court next month while Alex remains on an extended bail.
