NCDC appeal against Yama Security set

An appeal filed by the National Capital District Commission against Yama Security Services (YSS) has been set for the August Supreme Court sitting.

The matter came for directions hearing today in the Supreme Court where the matter was set.

This case is the appeal which NCDC filed against the decision of the National Court on March 2, 2016 which ordered NCDC to pay Yama Security Services (YSS) Ltd a total of K17,871,510 in damages for breaching a contract, 18 years ago.

NCDC is appealing this decision on 10 grounds. It is seeking orders from the Supreme Court to have the National Court’s decision of March 2, 2016 quashed.

The appeal has been deferred since August last year when the matter was initially fixed for hearing.  

It was deferred since August last year because the transcript of the March 2, 2016 decision was not made available in time to the Supreme Court.

An outstanding application that was moved by Yama’s lawyer, Ben Lomai will also be dealt with in the August sitting.

This is the application where Yama asked the court to disqualify two of the three judges sitting on the three-man Supreme Court bench.
