Witness statement signed by another person, lawyer tells court

Lawyer representing the two police officers who are allegedly involved in forcing a woman to swallow two condoms has told the court the man witness statement was not signed by the author.

In what is called the section 96 statement which is given to court after its ruling on sufficient evidence against the accuseds, lawyer representing  police officers Joshua Yawijah and Jacklyn Tanda said the witnesses’ statement was not signed by the author of the statement.

This is the statement of the woman whom they allegedly forced to swallow condoms.

The lawyer also said the video that was allegedly recorded by Tanda which shows Yawijah forcing the woman to swallow the condoms was not contained in the hand-up brief that was produced by the police investigating officer to the court.

This comes after the court on its ruling on the sufficiency of evidence last month said it found overwhelming evidence against the two forcing a woman to swallow two male condoms at the Boroko Police station on Dec 4, 2015.

Magistrate Cosmas Bidar in his ruling then also said the court was assisted with a copy of the video that was also circulated on social media Facebook.

Magistrate Bidar as per the normal committal court process will now have to re-consider the evidence before the court and the section 96 statements of the two officers before he makes a ruling as to whether he will commit them to stand trial at the National Court.

His ruling will take place on Sept 22.
