Soldiers in Yinu case to appear in court tomorrow

The six soldiers who were rearrested on March 24 in Port Moresby for the alleged murder of Salvation Army student Jeremiah Yinu will return to the Committal Court tomorrow (Monday).

Currently held at the Military Police holding cell at Murray Barracks, the six are expected back in court before Magistrate John Kaumi for mention at the Bomana Court house. 

They are Jude Nidung (24) from Finschhafen in Morobe, David Travolta (23) from Nuknuk village in Huon Gulf, Morobe Province, Gregory Tuaki (28) of Dinam village, Bogia district in Madang, Alwin Matiabe (26) from Guala village, Koroba district in Hela Province, Tobias Samson (26) from Singing village, Baiyer district, Western Highlands Province and Kenneth Yangun (25) of Mendi in Southern Highlands Province.

They were re-arrested just before the Easter long weekend after the committal Court struck out the case against them on March 16.

Travolta, Samson, Tuaki and Matiabe were arrested on March 24 and served their files. Nidung and Yangun were later arrested and also served their files. They remain in custody.

The case was struck out after the police investigating officer failed to compile his completed investigation in time before the court.

The hold-up was said to be with the police obtaining affidavits from the doctors who attended to the late student. This saw the case being dragged on for five months.

As a practice of the Committal court, police investigating officers must produce brief hand-out facts of their investigation to the defendants and the court within a period of three months, from the date they were arraigned in court.

It was alleged the soldiers were involved in a fight with students from the Kilakila Secondary School during a cultural show at the Coronation Primary School on July 25, 2015. The fight resulted in the Grade 11 Salvation Army student, Jeremiah Yinu, being hospitalised after receiving life threatening injuries.

Yinu lost his life in October last year.
