Nepo appeal date fixed

A date has been set by the Supreme Court for a three-judge bench to hear the appeal filed by former acting Correctional Service Commissioner, Bernard Nepo.

Nepo’s appeal is against the decision of the National Court on May 5, which quashed his appointment as acting Commissioner and reinstating Michael Waipo as Correctional Service Commissioner.

Justices George Manuhu, Allan David and Hitelai Polume-Kiele will hear the appeal on August 19.

Chief Justice Sir Salamo Injia in issuing directions regarding the matter ordered parties to fix the appeal book before the fixed hearing date.

They were also ordered to file arguments before August 19.

Nepo’s appeal is challenging the decision of the National Court, which was handed down by Justice Collin Makail on May 5, quashing his appointment as acting Commissioner and reinstating Michael Waipo as Correctional Service Commissioner.

On June 24, the same three-judge Supreme Court bench dismissed an application filed by Nepo seeking to stay that National Court decision and reinstate him to office as Commissioner Correctional Service.
