Lack of information has case struck out

A case involving an alleged armed robbery that took place outside the Mogoru Moto building at Port Moresby was struck out by the Waigani District Court today.

Christopher Kapun of Yangoru, East Sepik Province and his co-accused Yange Mapusa of Wabag, Enga Province had the case against them struck out after police officer in carriage of the investigation failed to prosecute in time.

The two first appeared in court on September 18 this year and after three months, no information was given by the investigation officer nor were their investigation files served to them by police.

This resulted in the Court striking out the matter today for warrant of prosecution.

Magistrate Cosmas Bidar in striking out the case, also said Mapusa had been at large after he escaped from custody while Christopher Kapun was remanded at Bomana.

It is alleged Kapun and Mapusa, while in the company of others held up a woman at Down Town Port Moresby and got the vehicle she was driving on September 8. Both men were allegedly armed at the time of the robbery.

Both were kept in custody at Bomana until Mapusa escape.

Bidar in dismissing the case said as per section 37(4) of the Constitution, everyone charged with an offense has the right to have that offense dealt with by the court in a reasonable time.

He added as far as the court was concerned, no information was received on the progress of the investigation and therefore  decided to dismiss it.
