Ruling next week for Madang regional review

The Supreme Court has reserved its ruling on an application seeking leave to review the National Court’s decision in ordering a recount into the Madang Regional seat.

Hearing on an application seeking leave to review the decision concluded on Friday before Chief Justice Sir Salamo Injia.

A ruling is expected on Monday March 21.

Retired Defense Force Commander Major-General Jerry Singirok’s lawyer Brendan Lai presented his arguments on Friday before the Supreme Court.

He opposed the application saying the trial judge did not fall into error in his decision to order a recount for the seat.

Peter Yama’s lawyer Ben Lomai however submitted that only one judgment was given for the two petitions (Singarok and James Yali’s) despite an earlier order for the National Court to run the two petition trial separately.

It was also put to court that the order for recount was sought by Yali whose petition was dismissed.

Singirok asked the court for a by-election in the petition.

A stay application that was filed by Yama will be moved in court, pending the ruling on the leave application on Monday.
