Over 200 evictees to file human rights case

Around 200 evictees at the ATS settlement, who were displaced last year from a piece of land identified as portion 2305, say they will be filing a case against the state for breach of their human rights.

The group, led by Gibson Asina and John Kuri, had their lawyer serve the section 5 notice on the state. 

They claim they were forcefully evicted on 2 and 3rd June 2017 after they paid the landowners for a piece of land. 

They later came to learn that the portion of land was under a court battle in the National Court. 

They said all communication was through the landowner however, they later watched helplessly as bulldozers forcefully removed their houses. 

“We were not given any prior notice of the eviction exercise by the developer. In short, the eviction exercise was carried out in an inhumane manner,” Evictee Kuri said. 

“This one in our case we feel is illegal. We want to bring our plight, the trauma and hardship we are facing to the view of the public so that justice is served,” he added. 

The piece of land which is in dispute is located past the Kiki Barracks. 

Development has since taken place on the land while the previous occupants have been displaced. 

This newsroom was in contact with their lawyer, who is still in the process of filing that case. 

It is understood a previous case over that same piece of land remains in court.
