Aviation charge against Cangah withdrawn

​The woman who was arrested over an alleged fight onboard a Brisbane-bound aircraft on October 7 last year has had one of the charges against her withdrawn in court.

The Boroko  District Court has withdrawn the charge of threatening a member of the crew of an aircraft, under section 262 of the Civil Aviation Act, against the defendant, Brenda Cangah.

Cangah of Wara Kum, Hagen Central in the Western Highlands Province, was arrested on Oct 10 last year and charged with unlawful assault under section 6(3) of the Summary Offense Act. She was also charged with threatening a member of the crew of an aircraft, under section 262 of the Civil Aviation Act.

The charge under the Civil Aviation Act was withdrawn in court on January 24 because the Boroko District Court does not have the jurisdiction to deal with the charge. Offenses under the Civil Aviation Act can be dealt with by the Committal Court.

This charge was withdrawn after Police Prosecution indicated in court on January 11 that it was beyond the jurisdiction of the Summary Offense court.

This case stems from allegations that Cangah used a bottle of Red Door perfume to hit the flight attendant, Elisabeth David’s face (complainant) onboard a Brisbane-bound aircraft on Oct 7 last year. She is also alleged to have pulled her scarf in the process.

Statement of facts before the court also alleges that the complainant sustained a scratch to her left cheek.

Initial reports from Airport police stated that the incident was over an alleged affair.

Cangah will return to the Boroko District Court on March 23 for mention on the unlawful assault charge.
