Trial against Potape commences

The retrial against Komo-Margarima MP, Francis Potape, commenced this morning at the Waigani National Court before Justice George Manuhu.

The trial was later adjourned to 1.30 this afternoon to allow time for the state to fix the charge against Potape, after one was struck out or removed from the allegations.

The charge or indictment was supposed to be read and explained to Potape, which is the normal process at the beginning of a trial before witnesses are called in. However, this did not take place.

Initially on committal from the District Court, Potape was charged with conspiring with others to defraud the state and misappropriating K330, 000, monies belonging to the Komo-Margarima Joint District Planning and Budget Priorities Committee (JDP&BPC).

The charge of conspiracy was struck out or deleted from the charges presented this morning. However, Justice Manuhu adjourned to after lunch to give state more time to fix the indictment.

The proper charges and allegations state is bringing against Potape are expected to be fixed, read and explained to him this afternoon.

Potape is facing allegations he dishonestly applied to himself and the use of others K330,000, monies belonging to the Komo-Margarima JDP&BPC.

State alleges Potape, being the chairman of the JDP&BPC, passed a resolution on Nov 21, 2010, to pay themselves outstanding sitting allowances covering transport, security and food. This included 12 meetings from 2009-2010.
