Travel Air wants case thrown out

The National Court will hear an application by Travel Air’s Mangi lo Peles, seeking to dismiss a proceeding filed by American company AeroCentury Corporation.

The proceeding was filed by AeroCentury Corporation over the outstanding payment of aircrafts it leased to Travel Air.

Lawyer representing Travel Air, Justin Haiara filed the notice of motion on Feb 26, asking the court to dismiss the proceeding and also dismiss orders issued by the court last month.  

It was filed on the main ground that Travel Air is a locally-owned company.

The application came before Justice Ere Kariko however, it was adjourned and referred back to Justice Derek Hartshorn, who previously dealt with the case.

Justice Hartshorn will now hear the application on March 16.

Last month, Justice Hartshorn ordered the grounding of the four aircrafts used by Travel Air.

The court also ordered the return of the four aircrafts leased by AeroCentury Corporation after Travel Air allegedly failed to pay K21.2 billion in lease fees.

Meanwhile, lawyer representing AeroCentury Corporation said one of the planes held in Madang was flown into Port Moresby on Wednesday while another is still parked in Madang.
