Sony Music legally can't get Kesha out of her contract with Dr Luke

As public support for Kesha to be freed from her record label intensifies, Sony Music has explained its position in the ongoing legal battle.

The 28-year-old singer was denied a preliminary injunction earlier this month, suffering a major setback in her bid to break her contract with Dr Luke's Kemosabe Records.

Kesha has accused the producer and record label owner of sexually abusing her - a claim he has strenuously denied.

Kemosabe Records is a subsidiary under Sony Music, so Kesha and her fans have called for the major label to take action.

"Sony has made it possible for Kesha to record without any connection, involvement or interaction with Luke whatsoever, but Sony is not in a position to terminate the contractual relationship between Luke and Kesha," the company's attorney ​Scott A Edelman​ said in a statement.

"Sony is doing everything it can to support the artist in these circumstances, but is legally unable to terminate the contract to which it is not a party."

The problem arises because Kesha is signed to Dr Luke's Kemosabe Records as part of a separate deal with his production company ​Kasz Money Inc.​

Earlier this week, Kesha wrote a passionate plea on Facebook to Sony Music saying that her legal battle is purely about "being free from my abuser".

​"All I ever wanted was to be able to make music without being afraid, scared, or abused," she wrote.

"This case has never been about a renegotiation of my record contract - it was never about getting a bigger, or a better deal.

"This is about being free from my abuser. I would be willing to work with Sony if they do the right thing and break all ties that bind me to my abuser."​

Adele, Lady Gaga, Lorde and Ariana Grande are among the high-profile female stars who have publicly voiced their support for Kesha.

Taylor Swift has also offered the star $250,000 towards her legal battle costs.

Dr Luke responded to Kesha's claims once again this week, tweeting: "I didn't rape Kesha and I have never had sex with her.​"
