Namah tribunal temporarily stayed

The leadership tribunal that was set up to investigate allegations of misconduct in office against Vanimo Green MP Belden Namah has been temporarily stayed by the National Court.

 Justice David Cannings this afternoon (Oct 29) issued orders restraining the tribunal from reconvening until November 6 (next week Friday).

The tribunal was adjourned to next Tuesday (Nov 3) on Tuesday this week by members of the tribunal.

Justice Cannings temporarily stayed the tribunal convening because Namah’s lawyer Greg Sheppard today (Oct 29) moved a notice of motion on an issue of jurisdiction regarding the tribunal’s appointment.

They moved the application this afternoon seeking interim orders to restrain the tribunal from convening until the Supreme Court hears and determines matters of constitutional issues in relation to the proceeding (tribunal) and its appointment.

Counsel representing the tribunal members,  Laias Kandi, sought an adjournment as they were only served the materials yesterday.

Justice Cannings stayed the tribunal till next week Friday while the applications will return before him next Wednesday (Nov 4).

He further issued orders for the Public Prosecutor and the Ombudsman Commission to be joined in the National Court proceeding as defendants.
