Namah’s motion adjourned to January

The National Court will hear a motion filed by Vanimo Green MP Belden Namah seeking referral of certain constitutional questions to the Supreme Court.

The motion will be heard next January 15.

Namah and his lawyer appeared before Acting Judge Danjo Koeget today after he filed an urgent application before the Human Rights track on December 17.

The motion seeks injunction orders as well as for the National Court Human Rights track to refer constitutional questions to the Supreme Court for interpretation.

It also seeks a stay of the leadership tribunal inquiry against Namah from proceeding after the 2016 legal year starts in February. 

The tribunal was adjourned from November 25 to February 9, 2016.

The nature of the orders Namah is seeking is in relation to the process in which the Chief Justice Sir Salamo Injia appointed the tribunal when he was involved in one of the allegations the leader is facing.

This was the incident in 2011 where the leader allegedly stormed into a court sitting presided over by the Chief Justice.

Counsel representing the Public Prosecutor, Laais Kandi, who is also representing a nominal defendant, members of the Leadership tribunal as well as the Chief Justice’s lawyer, appeared before the court today seeking an adjournment of the motion instead.  

 An adjournment was sought as they were “short served’’ of the matter returning today, only yesterday (Dec 28).

Acting Judge Koeget when presiding over the matter said it involves a national leader and the court must be properly addressed of the issue before it.

The matter will return on January 15 where the motion filed by Namah on December 17 will be heard by the court.
