Legality of Manus centre to go before full court

The case challenging the legality of the Manus Regional Processing Centre will go before a full bench Supreme Court hearing at the end of this month.

Applicant in the matter Beldan Namah filed the application against Foreign Affairs Minister Rimbink Pato as the first respondent, the National Executive Council and the State as second and third respondents.

The matter came before Justice George Manuhu during the Supreme Court hearing on Monday (October 6).

The hearing of the matter has been set for October 29 and will be heard by a panel of five judges.

Namah filed the application against the State on the ground that the processing centre was unconstitutionally set up and thus the asylum seekers were detained contrary to their rights under section 42 of the PNG Constitution.
