Lawyers get ready for hospital boss’s appeal case

Parties involved in the appeal against sentence case of Modilon General Hospital’s CEO Sister Christine Gawi are still preparing the appeal book.

The case returned to the Supreme Court early this week where Gawi’s lawyer Deborah Onga from Ashurst lawyers informed the court they had obtained transcripts of Justice David Canning’s decision on August 17 this year at the Madang National Court.

She however told the court that they were still in the process of filing the appeal book.

The matter has since been adjourned to October 19 to allow for that while parties were told to file the appeal book by October 16.

Gawi was sentenced  to six weeks in prison at the Beon Correctional Institution on August 19 for contempt of court however is challenging that sentence term while she remains on bail.

She was found guilty after trial of contempt of court for disobeying an order of the National Court, dated 22 January 2014.

The order required Gawi in her capacity as chief executive officer of a public hospital to reinstate the plaintiff (a dismissed officer), Sr  Elizabeth Mandus Wukawa by 5 February 2014.

It also ordered Gawi to pay Wukawa’s lost salaries and entitlements by 5 March 2014.

Gawi disobeyed the order by not reinstating the plaintiff by 5 February 2014.
