Lawyer arrested over conspiracy

A lawyer was arrested and charged along with two others for presenting an affidavit that was allegedly not true and had a false signature in the Waigani National Court.

Timothy Cooper, 41, of Yanga village in the Ahi sub-district of Morobe Province appeared at the Waigani District Court.

Magistrate John Kaumi read the charges to him in court and adjourned the matter to Sept 22. His bail is extended however he is required to provide two affidavits of two guarantors who will ensure he attends his court hearing as well as an affidavit stating his place of residence.

Police allege that Cooper on June 21 at the Waigani National Court house, conspired with a Julie Kapi and one other to present an affidavit or a statement that was not genuine and had  a false signature of a said person (Anderson Kola).

The affidavits were allegedly not signed or written by the said person (Anderson Kola) which was used as a document of an application in a case filed by Daniel Kapi over an estate.

Police also alleged that on the same date and venue, Cooper knowingly and fraudulently uttered a false document in the form of an affidavit in the matter of an application in the administration in the interstate estate by Daniel Kapi.

He was arrested and charged under sections 407(1) and section 463 (1) of the Criminal Code of PNG.

These are just allegations and police will investigate the matter further. The two others also allegedly involved are expected to appear in court this week.
