Court grants Kavo bail

The Committal court has granted bail to convicted Gulf Governor Havila Kavo who was arrested and charged on June 17 for the second misappropriation charge against him.

Kavo was refused bail since his arrest by police on Wednesday and made his first appearance in court in relation to the second charge on Friday.

He was granted K5, 000 bail by Magistrate Cosmos Bidar.

The second charge against Kavo alleges that he dishonestly applied to his use K783, 195.70 -monies belonging to the state between January 15 and 27, 2015.

His second alleged offense comes after he was granted bail by the Supreme Court on December 23, 2015 on a pervious misappropriation charge.

Kavo appeared  with his lawyer who filed for bail application on the grounds of  section 9(1)(b) of the bail act that a person charged with committing an offense whilst on bail shall not be refused bail unless the court is satisfied on reasonable grounds.

His lawyer said three other people were previously charged for the identical charge and were released on bail.

He said Kavo was the governor for the host province of the second LNG project and being in custody will disadvantage his province of the negotiation process with developers in the province.

Kavo also appealed on bail on the grounds that he was the sole bread winner for his family and that his wife had a serious case of high blood pressure and needed special attention.

Kavo’s lawyer in his submission this afternoon said the complainant in the matter was the same complainant as in the first charge where he was convicted of last year.

Police prosecutor Polon Koniu however opposed bail on the ground that Kavo was previously convicted on a misappropriation charge and is now alleged to have committed a second offense while released on a Supreme Court bail.

Kavo was granted bail on the condition that he does not commit any other offense whilst out on bail.

Kavo will return to the Committal court on July 20 for mention.
