Baki seeks restraint of Damaru’s legal representation

The National Court matter filed over the Director of National Fraud and Anti-Corruption Directorate Matthew Damaru’s suspension returned to court today before Justice Allan David.

A number of motions and applications filed by parties since April 18 returned today however the court proceeded to hear the application filed by the second respondent, Police Commissioner Gari Baki.

His lawyer Ronald John Webb preceded with the applications filed early this month seeking two orders of the court.

The application was filed around the circumstances of the legal representation of Damaru and his engagement of private lawfirm, Jema lawyers, McRonald Nale and Greg Egan.

Baki is seeking orders to restrain Damaru from engaging Jema Lawyers or any other private law firm until he consents the Attorney General who approves brief out of cases to private law firms.

He is also seeking the restrain lawyers McRoland Nale, Greg Egan and law firm Jema Lawyers from acting on or receiving instructions from Damaru.

An objection to competency was raised by Damaru’s lawyer, Greg Egan on grounds he, Nale or Jema Lawyers were not personally served the motion. This objection was refused by Justice David who ruled to go ahead and hear the application.

Meanwhile two other applications filed by the state(Third respondent)  and Victor Isouve (First respondent) to dismiss the interim orders issued by the court on April 18.

Hearing continued this afternoon.
